1. Scope
The following terms and conditions apply to all orders placed through our online shop. Our online shop is directed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.
2. Contracting party, conclusion of contract, correction options
The purchase contract is concluded with DS Shopping GmbH.
By listing the products in the online shop, we make a binding offer to conclude a contract for those products. You may first place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose during the order process. The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a further confirmation by email.
3. Contract language, storage of the contract text
The language(s) available for concluding the contract: German, English
We store the text of the contract and send you the order details and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.
4. Delivery terms
Delivery options
We ship the products to the delivery address provided during the order process.
We deliver by shipping only. Unfortunately, collection of the goods in person is not possible.
5. Payment
5.1 Prices
The prices stated at the time of the order apply. These are total prices and include statutory VAT.
5.2 Payment methods
The following payment methods are generally available in our shop.
Payment in advance
If you select payment in advance, we will send you our bank details in a separate email and deliver the goods once payment has been received.
Credit card
You provide your credit card details during the order process. Your card will be charged immediately after the order is placed.
Apple Pay
In order to pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA (“Apple”), you must use the “Safari” browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your access data and confirm the payment instruction. The payment transaction is carried out immediately after the order is placed. You will receive further information during the order process.
Google Pay
In order to pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland (“Google”), you must be registered with Google, have activated the Google Pay function, authenticate yourself with your access data and confirm the payment instruction. The payment transaction is carried out immediately after the order is placed. You will receive further information during the order process.
PayPal, PayPal Express
In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. You will receive further information during the order process.
PayPal may offer registered PayPal customers selected according to its own criteria further payment options in their customer account. However, we have no influence on whether these options are offered; further individually offered payment options concern your legal relationship with PayPal. You can find more information on this in your PayPal account.
6. Warranty and guarantees
6.1 Liability for defects
The statutory law on liability for defects applies.
6.2 Guarantees and customer service
Information on any additional guarantees that may apply and their precise terms can be found with the respective product and on dedicated information pages in the online shop.
7. Liability
We are always liable without limitation for claims based on damage caused by us, our legal representatives or vicarious agents
- in the event of injury to life, body or health,
- in the event of intentional or grossly negligent breach of duty,
- in the case of guarantee promises, where agreed, or
- insofar as the scope of the German Product Liability Act (Produkthaftungsgesetz) applies.
In the event of a breach of material contractual obligations by slight negligence on the part of us, our legal representatives or vicarious agents — obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the contracting party may regularly rely (cardinal obligations) — liability is limited in amount to the damage foreseeable at the time the contract was concluded and typically to be expected.
Otherwise, claims for damages are excluded.
8. Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find here . Consumers have the option of using this platform to settle their disputes.
We are obliged to take part in dispute resolution proceedings before a consumer arbitration board in order to settle disputes arising from a contractual relationship with a consumer, or disputes as to whether such a contractual relationship exists at all. The competent body is the Universalschlichtungsstelle des Bundes at the Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, Germany, https://www.universalschlichtungsstelle.de/. We will take part in dispute resolution proceedings before this body.
Should individual clauses of these terms and conditions be wholly or partly invalid, the remainder of the contract shall remain valid. Insofar as individual clauses are invalid, the content of the contract shall be governed by the statutory provisions.
